ASIA-PACIFIC ECONOMIC COOPERATION (APEC) 17TH CONFERENCE ON GOOD REGULATORY PRACTICES (GRP17)


GRP17 took place on 19-20 August 2024 in Lima, Peru, gathering APEC economy representatives to explore strategies for improving regulatory quality and driving economic growth. The conference aligned with APEC 2024’s theme, "Empower. Include. Grow," focusing on "Innovation and Digitalisation to Promote Transition to the Formal and Global Economy."

Key Themes of the Presentations:
  1. Regulatory Quality and Economic Growth: High-quality, transparent and evidence-based regulations were highlighted as essential for boosting productivity, competitiveness and transitioning to formal economies. New Zealand (NZ) demonstrated how its competition policy, driven by regular market studies, ensures fair competition and supports economic growth, particularly in key sectors like energy and retail.
  2. Digital Transformation: The role of digital tools in modernizing regulatory practices was emphasised. OECD’s International Regulatory Cooperation (IRC) platform was highlighted as a tool for sharing case studies and best practices. NZ encouraged contributions of case studies from economies to the IRC to enhance global learning to help reduce trade barriers and promote regulatory cooperation. Thailand’s use of AI in public consultations was also noted for its innovative approach to managing large volumes of feedback and making the process more inclusive.
  3. Inclusive Stakeholder Engagement: Comprehensive stakeholder involvement, especially for marginalised groups and SMEs was emphasized as crucial. Chile shared its efforts to use a targeted approach in public consultation processes, focusing on reducing complexities that often hinder smaller businesses, thereby promoting more equitable regulatory outcomes.
  4. International Cooperation: The value of aligning domestic regulations with international trade standards to reduce barriers and foster economic integration was discussed, with insights from Chile and Peru on maintaining competitiveness in global markets.
  5. Continuous Improvement: The importance of regular ex-post evaluations to maintain regulatory relevance and effectiveness was highlighted. Mexico shared its experience with ex-post Regulatory Impact Assessments (RIAs) to refine and improve existing regulations.

Malaysia contributed in Sessions 2 and 5 of the conference.
Session 2: Institutionality and Governance Models to Facilitate Transition to the Formal Economy

Mr. Mahadi Hasbullah presented Malaysia's approach to regulatory governance, emphasizing centralized coordination and decentralized execution. The PEMUDAH initiative was highlighted for ensuring consistent and inclusive regulatory practices across government levels, emphasizing the need for a unified regulatory framework.

Session 5: Technology Tools and Innovative Resources for International Regulatory Cooperation

Ms. Hafizoh Md Aris presented on Malaysia’s digitalization efforts under the National Policy on Good Regulatory Practice (NPGRP). Tools like the Digital Regulatory Notification (DRN) and the Unified Public Consultation (UPC) platform were shared, alongside Malaysia’s future initiative on the development Digital Regulatory Information System (DRIS) demonstrating Malaysia’s commitment to modernizing its regulatory framework.

Overall, GRP17 reaffirmed the essential role of GRP in fostering sustainable economic growth, promoting market openness and facilitating the transition from informal to formal economies.

To improve construction industry productivity through wider adoption of IBS, the Malaysia Productivity Corporation (MPC), through the Construction & Built Environment Productivity Nexus (COBEPN) held a productive brainstorming session with the participation of various stakeholders. This session aims to obtain views and feedback on the roposed amendments to the PWD Standard Form Contract 203A, specifically designed to facilitate greater IBS adoption. The session brought together key players from across the construction industry, such as representatives from KKR, JKR, CIDB, MBAM, professional architects, engineers, and IBS manufacturers, for a collaborative exchange. Structured discussions centered on three core areas: the industry IBS adoption rates, challenges under current contract terms, and recommendations on the proposed amendment. This collaborative exchange concluded with a summary, underscoring the sector's unified commitment to construction productivity and reform in Malaysia. Kelab Rekreasi Timah Tasoh merupakan antara pengusaha perkhidmatan bot ronda serta pelbagai aktiviti riadah dan rekreasi di Dataran Empangan Timah Tasoh, Perlis. Pada tahun 2024, kelab ini telah menerima pensijilan Malaysia Tourism Excellence (MaTEx), yang seterusnya menyumbang kepada peningkatan hasil jualan yang ketara (peningkatan jualan sebanyak 35.8%) serta memperkukuh kualiti operasi dan perkhidmatan yang ditawarkan. Bagi memastikan pertumbuhan produktiviti yang mampan dan berterusan, satu sesi perbincangan strategik telah diadakan melibatkan wakil kelab, Tourism Productivity Nexus (TPN) dan pemain industri. Sesi ini bertujuan mengenal pasti potensi penambahbaikan dan merangka inisiatif yang boleh memacu daya saing kelab dalam sektor pelancongan dan rekreasi. Antara cadangan yang dibincangkan termasuk penekanan terhadap aspek keselamatan dan bantuan kecemasan bagi menjamin kesejahteraan pengunjung, peningkatan usaha promosi dan pemasaran melalui penggunaan teknologi kecerdasan buatan (AI) dan platform media sosial, penambahbaikan sistem tempahan perkhidmatan secara digital, serta menjalin kerjasama strategik dengan pihak swasta bagi merancakkan lagi aktiviti rekreasi di kawasan Timah Tasoh. Objektif utama penggubalan akta ini adalah untuk memastikan mekanisme dan proses PSB yang lebih berkesan, selain mewujudkan ambang persetujuan yang jelas dalam pelaksanaan dasar-dasar berkaitan. Sesi bimbingan ini diadakan bagi membimbing pasukan projek PKNP dalam usaha mengenal pasti punca utama kepada isu yang dihadapi serta memetakan proses kerja sedia ada bagi dua (2) projek RKB yang sedang dilaksanakan iaitu Mempercepat Proses Kelulusan Projek Pembangunan Utiliti melalui Penubuhan Agensi Penyelaras Negeri dan Transformasi Proses Kelulusan Projek Pembangunan oleh MMK: Kajian Kes Projek LUMIC, Manjung. Melalui sesi ini, pendekatan berasaskan analisis sistematik dan kolaborasi antara agensi teknikal dan bukan teknikal yang terlibat dalam proses kelulusan perlu diterapkan bagi memastikan pelaksanaan penambahbaikan yang akan dibangunkan dapat dilaksanakan dengan cekap dan mampan, selari dengan objektif RKB dalam memperkasa penyampaian perkhidmatan awam. Sebagai langkah susulan, pasukan projek PKNP akan melaksanakan pengumpulan data menyeluruh bagi setiap peringkat proses kerja yang terlibat. Dapatan daripada aktiviti ini akan digunakan untuk mengenal pasti isu sebenar di lapangan serta merangka cadangan penambahbaikan yang bersasar, praktikal dan berpotensi tinggi untuk meningkatkan kecekapan sistem sedia ada.

Nexus Produktiviti Kimia telah mengadakan perbincangan bersama HRDCorp mengenai permohonan Special Grant bagi program Dangerous Goods Safety Advisor (DGSA) . Program DGSA ini merupakan satu program latihan dan persijilan bagi melahirkan penasihat keselamatan yang kompeten dalam pengurusan barangan berbahaya. HRDCorp mengakui bahawa program ini sangat penting kerana ia merangkumi latihan teori serta praktikal yang memenuhi piawaian antarabangsa UNECE-ADR serta dapat membantu meningkatkan peluang kerjaya peserta melalui pensijilan antarabangsa IRU Academy Geneva. Program menyasarkan seramai 500 peserta ditauliahkan sijil kompetensi DGSA dan memberi impak positif dari sudut keselamatan, pematuhan undang-undang, reputasi syarikat dan nilai ekonomi.

Emphasis was placed on making the roadmap more practical and SME-friendly by incorporating affordable, easy-to-adopt technologies such as cloud-based solutions, low-cost digital tools, and scalable platforms that minimise upfront investment. This feedback will play a key role in refining the roadmap to ensure it is relevant and impactful for SMEs.
